Terms of Service

By downloading, installing, accessing, or using the Nimble mobile applications, website located at nimblechicago.com , or any related services (collectively, the “Service”), you agree to these Terms of Service (“Agreement”). The Service is provided by Godega Market LLC d/b/a Nimble (“Nimble”, “we”, “our”, “us”). If you do not agree, you must not use the Service.
1. Acceptance of Terms
This Agreement is a binding contract between you and Nimble Chicago (“Nimble”, “we”, “our”, “us”). We may modify this Agreement at any time by posting an updated version. Your continued use after changes are posted constitutes acceptance of the new terms.
2. Accounts, Eligibility & User Conduct
- You must be at least 18 years old to use the Service.
- Provide accurate, current, and complete registration information and maintain the confidentiality of your login credentials.
- You are responsible for all activity under your account and may only maintain one personal account.
- You agree not to use the Service for unlawful or fraudulent purposes, interfere with the Service or networks, or attempt to reverse engineer or derive source code from the Software.
3. Orders, Payments & Subscriptions
- All payments are processed through authorized third-party processors such as Square. We do not store full card numbers.
- Subscription plans (if offered) auto-renew unless canceled at least five (5) business days before renewal. Fees are non-refundable.
- We may accept or decline orders in our sole discretion. Title and risk of loss pass to you upon transfer to the carrier.
- For alcoholic beverages (where permitted), you must be 21+ and present valid ID upon delivery or pickup.
4. Intellectual Property & License
Nimble and its licensors retain all ownership rights in the Service and Software. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes. You may not sublicense, resell, modify, reverse engineer, or remove proprietary notices from the Service or Software.
5. Third-Party Services
The Service integrates with third parties (e.g., Square, Supabase, delivery partners). Interactions with third parties are solely between you and the third party. Nimble is not responsible for actions or omissions of third-party providers.
6. Disclaimers & Limitation of Liability
- THE SERVICE AND SOFTWARE ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
- Nimble’s aggregate liability shall not exceed the amounts you paid in the six (6) months preceding the claim.
- We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or data.
- We are not responsible for internet delays, failures, or damages inherent in networking and electronic communications.
7. Indemnification
You agree to indemnify and hold harmless Nimble, its affiliates, and licensors from claims arising out of your use of the Service, violation of this Agreement, or infringement of third-party rights.
8. Governing Law, Arbitration & Class Action Waiver
- This Agreement is governed by the laws of the State of Illinois, USA.
- All disputes must be resolved through binding individual arbitration in Cook County, Illinois. You waive the right to a jury trial.
- You waive the right to participate in class actions or representative proceedings.
- You may opt out of the arbitration/class action waiver within thirty (30) days of first agreeing by providing written notice.
9. Termination
We may suspend or terminate your access to the Service at any time for any reason. Upon termination, your right to use the Service ends immediately.
